HR tells employee she needs to work 2 more months following resignation despite working 3-month notice period: 'I stayed out of goodwill'

    Hi everyone, I need some advice regarding my resignation and notice period. My workplace is toxic af with my boss being bitchy.
  • Last year, when I had resigned(my last working day being 1 oct 2025), the HR at that time emailed me saying that I was expected to continue employment until February and that if I left before that, I would need to give at least 30 days' notice.

  • I stayed and continued working as requested. I stayed out of goodwill as there were only 3 designers in the company.
  • Now in 2026, I resigned again since it's Feb, and a different HR person(because the previous one has quit) has replied saying: • The previous HR (who sent that email) "does not exist on our team" • That email is considered null and void As per my employment contract, I must serve a 2-month notice period AGAIN What should I do?

  • rodimus 147 A HR person leaving does not null and void something. Leave and if they try anything they just set you up for a nice little lawsuit.
  • rodimus 147 If you have served your contract and done what your supposed to do and they try to retaliate against you yes you can sue them.
  • rocketmn69_ Ask them for an original signed copy. If they can't produce it, start packing up your desk
  • peachyy97 Original Poster's Reply They don't have any signed copy. There was a contract I signed a long time ago.. 2 years ago which says you have to serve two months notice. I have already served 2 months in October.. I just stayed till February out of goodwill
  • rocketmn69_ Do you have a signed and dated copy of your original resignation letter and their acceptance of it? Gather all that evidence of communication, then walk away
  • peachyy97 Original Poster's Reply I have it all on email because usually everything here is operated via email. I have their resignation acceptance too.
  • auditor2 If you under an employment contract and have fulfilled exit requirements changes in HR staff are not your responsibility

  • peachyy97 Original Poster's Reply I agree, now the hr is requesting me to serve 1 month.. I offered 2 weeks but they're not agreeing. I will just not show up
